Terms of service

These terms govern use of the Nexly service supplied by A.K.B.S. ApS (trading as Nexly), Gammel Skovvej 6, 2770 Kastrup, Denmark, CVR 44457415. Contact: help@nexly.dk.
1. The service
Nexly provides a hosted returns and exchanges portal that integrates with Shopify and third-party logistics providers. Features may change as the product develops; we will not materially reduce a paid feature without notice.
2. Accounts and merchant responsibility
The merchant is responsible for keeping credentials secure, for the accuracy of the data connected to Nexly, for its own return policy and consumer-law obligations, and for holding valid agreements with its carriers/3PLs.
3. Fees and payment
Subscriptions are billed in advance per store per month. Prices are exclusive of VAT. Shipping labels are purchased under the merchant's own carrier or 3PL agreement and are not part of the Nexly fee.
4. Term and cancellation
The subscription runs month to month and can be cancelled at any time with effect from the end of the current billing period. Consumers ordering as private individuals have a 14-day right of withdrawal, which lapses once the service is fully delivered with their consent.
5. Availability and liability
We aim for high availability but do not warrant uninterrupted service. To the extent permitted by law, our total liability in any 12-month period is limited to the fees paid in that period. We are not liable for indirect losses, loss of profit or lost data caused by third-party services such as Shopify or a carrier.
6. Data protection
Where we process personal data on the merchant's behalf, our Data Processing Agreement applies and forms part of these terms.
7. Governing law
Danish law applies. Disputes are heard by the Danish courts, with the Court of Copenhagen as first venue. Consumers may also use the EU ODR platform.
